Terms

All products supplied by Eclipse carry a one year warranty.

The following terms and conditions do not affect your statutory consumer rights.

DEFINITIONS

Within these terms and conditions the following terms will be referred to:
Customer means the person or company to whom this document is addressed.

1. GENERAL
These terms and conditions are applicable to the supply of products by the Seller (Eclipse Garden Lighting Limited), hereafter referred as Eclipse, to the buyer hereafter referred as the Customer.

Eclipse make no representations about the suitability of the information contained in the documents and related graphics, or the products found on this website. All such documents and related graphics are provided "as is" without warranty of any kind. Eclipse hereby disclaims all warranties and conditions with regard to this information, including all implied warranties and conditions of usability, fitness for a particular purpose, title and non-infringement. In no event shall Eclipse be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of information available from this website.

The documents and related graphics published on this website could include inaccuracies or typographical errors. Changes are periodically added to the information herein. Eclipse may make improvements and/or changes in the product(s) described herein at any time.

2. PRICE
2.1 All prices are quoted in pounds sterling (£) and include VAT @ 17.5%.
2.2 Delivery is Free to the UK Mainland.
2.3 Delivery charges apply to addresses outside of the UK Mainland.
2.4 Price does not include assembly/installation.

3. PAYMENT
3.1 Payments must be made in pounds sterling (£) and by acceptable: · Credit or Debit card. WorldPay controls authorisation for your purchases, we do not see your credit/debit card number.
3.2 You may also pay by cheque, payable to 'Eclipse Garden Lighting Ltd'

4. PASSING OF PROPERTY
Eclipse, shall retain the property of the goods until the customer has made full payment and it has been received by Eclipse.

5. PASSING OF RISK
The risk in the goods shall pass to the Customer on delivery, as defined in clause 6.3 below.

6. DELIVERY
6.1 DELIVERY DATE - It is our policy to process and dispatch orders as soon as possible within 10 working days from the date of your order or as stated on the product page. The Victorian Lighting range will take longer due to this range being individually hand crafted, see product pages for current delivery times. Eclipse cannot be held responsible for delays in the delivery caused by the manufacturer, courier, or any other third party.
6.2 DELIVERY OF GOODS - UK orders are either delivered by us or direct from the manufacturer, by Royal Mail or Courier.
6.3 PASSING OF RISK - The Customer bears the risk once the goods have been delivered.

7. ACCEPTANCE
The Customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods, unless within seven working days after the day of their receipt of the goods, the Customer shall have notified Eclipse that the goods are damaged/faulty and are rejected. If no such action has been taken, Eclipse shall consider the products being as described, of satisfactory quality and fit for their purposes.

8. THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000
Under this regulation, the Customer has seven working days starting one day after the receipt of the goods to cancel the order. On cancellation of the order, the Customer is under a duty to restore the goods at their expense (to include insurance, postage & packing and/or courier costs) to Eclipse and in the mean time to take reasonable care of them. The returns procedure in section 9.2 below must be followed. Eclipse retain the right to recover the costs of restoring the goods to Eclipse should the Customer not return the goods in a resaleable condition and within the time-frame stated in section 9.2 below.

9. RETURN PROCEDURE
9.1 If the goods are to be rejected or the order cancelled in the time limit set in clauses 7 and 8 above, the Customer shall comply with the return procedure as defined in clause 9.2, below. Eclipse will not accept any returned goods should the return not follow the aforementioned return procedure.

9.2 The Customer must notify Eclipse in writing (e-mail, letter or fax) that they wish to reject the goods or cancel the order and obtain a returns number. The Customer is to pay for insurance, postage & packing and/or courier costs of the goods being returned. Include the original order number, customer name & address and the returns number within the package being returned. Once the returns number has been issued by Eclipse, the goods must be returned  by the Customer within seven working days to the following address:

9.3 The Customer is entitled to a replacement or refund to the value of the goods being returned unless the goods are damaged or missing. It is the responsibility of the Customer to ensure that any goods being returned are insured as any damaged or missing items will be charged to the Customer.


10. LICENSE AGREEMENT
The Customer shall respect all license agreements delivered by the copyright/trademark owners. Eclipse cannot be held responsible or liable for any misuses conducted by the Customer or any third party.

11. INSTALLATION

To comply with current regulations we recommend that all installations are carried out by a suitably qualified electrician.


12. INTERNATIONAL CUSTOMERS
Customers from outside the UK can only pay by International credit card. All other terms and conditions apply.

13.LAW
These terms and conditions are governed and shall be interpreted in accordance with the laws of England and Wales.
